Digital Millennium Copyright Act Notice
PerkChase is committed to dealing with copyright complaints in compliance with applicable laws.
If you believe that any content available on PerkChase.com (as defined in our Terms of Service) infringes one or more of your copyrights, please notify us by means of an emailed notice (“Infringement Notice”) providing the information described below to the email address listed at the end of this notice. It is the policy of PerkChase and it’s parent company, PrizeLeader, LLC to promptly remove content that is the subject of a correctly prepared notice under 17 U.S.C.A. Section 512(c). It is also our policy to replace content posted by our clients upon receipt of a Counter Notification that complies with DMCA requirements. In accordance with our above stated policy, be advised that we will not get involved in copyright disputes. We want to make sure that everyone is protected, and in doing so, we will strictly comply with all statutes of DMCA law as it is defined on the United States Copyright Office website.
We strongly encourage any individual or entity with a copyright concern to consult an attorney before submitting a notice of copyright infringement. Copyright laws allow individuals or entities to use a copyrighted work in certain ways without the copyright owner's permission. Please take note that Section 512(f) of the DMCA clearly states that any person who knowingly materially misrepresents in a DMCA notice that content is being infringed upon shall be liable for damages, including costs and attorneys' fees incurred by the alleged infringer.
All Infringement Notices must include the following for us to take action:
-An electronic signature of the copyright owner or a person authorized to act on their behalf;
-An identification of the copyright claimed to have been infringed;
-A detailed description of the nature and location of the content that you claim to infringe your copyright, including the business name, address, and phone number (which is available on all client ad pages), along with a digital copy of the image in question to permit PerkChase to find and positively identify that content;
-Your name, address, telephone number and email address; and
-A statement by you: (i) that you believe in good faith that the use of the content that you claim to infringe your copyright is not authorized by law, or by the copyright owner or such owner’s agent; and (ii) under penalty of perjury, that all of the information contained in your Infringement Notice is accurate, and that you are either the copyright owner or a person authorized to act on their behalf.
